Per Person Tour Prices Include: 1) Roundtrip economy class airfare on Cathay Pacific Airlines and specified flights within China; (2) Double occupancy hotel accommodations; (3) Meals and special events specified in the itinerary; (4) Private motorcoach sightseeing and transfers; (5) English speaking guide throughout; (6) Entrance fees; (7) Other special events and values as identified in the itinerary
Payment: Deposit of $300 per person required with passport copy upon reservation. Payment by
Check payable to "Asia Getaway Inc." Payments are deposited in a Union Bank of California, California, trustee account, used exclusively for this program. By law, Asia Getaway Inc. cannot and will not use these funds for any purpose other than to defray the program costs. While the money is in the bank, Union Bank, and NOT Asia Getaway Inc, is custodian of the funds. When the travel service companies are paid, Asia Getaway Inc. will have met its financial and trustee obligation for the travel services involved.
Prices do NOT include: (1) Airfares that are not explicitly stated in the itinerary or noted as specifically included in the tour price; (2) Passport and visa fees, if any; (3) Airport departure taxes not included in the airline ticket (4) All insurance; (5) All personal expenses, (e.g., phone, laundry, etc.); (6) All health and medical services, and related expenses; (7) Refunds for missed or unused services; (8) Accommodations in excess of the nights listed in the itinerary; (9) Overnight delivery fees or delivery fees for clients outside the continental U.S.; (10) Meals not specified in the tour itinerary.
Conditions of Prices: Prices are based on airfares, taxes and the relative value between the U.S. dollar and the currencies of the countries listed when the tours are priced and the folder is printed. If the exchange rates, airfares, or other travel costs change, the traveler may be assessed any extra charges, or credited a refund.
Changes of Itinerary: Asia Getaway Inc reserves the right to change the itinerary or services for reasons which may be out of our control, (e.g. airline schedule changes, number of people who join a tour, natural disasters, etc.) If changes are necessary, the traveler may be assessed any extra charges or refunds.
Cancellations and Other Charges: Cancellations must be made by letter, E-mail, or fax and NOT by telephone. Partial or total cancellation of tour services, regardless of reason, are subject to: (1) Funds that may be withheld or imposed by the airlines, hotels, cruise lines, sightseeing companies, etc.; and (2) A per person Asia Getaway's cancellation service fee, prorated before departure, as follows: $300 after reservation, 50% tour cost up to 30 days before departure, and 100% tour cost 15 days before departure.
Travelers whose changes result in rewritten air tickets will be charged whatever penalties the airlines may impose, and a $50 Asia Getaway Inc Service fee. Those applying within 45 days of departure will be assessed extra expenses caused by late enrollment, with a minimum charge of $50 per person because the airlines, hotels, etc. impose heavy cancellation fees.
Responsibility: The responsibility of Asia Getaway Inc. (AG) is strictly limited. As a tour operator, AG organizes, promotes, and sells tour programs and vacations consisting of certain travel services, including, but not limited to, surface transportation, sightseeing excursion, cruise/hotel accommodations, and meals and entertainment that AG purchases or reserves from various suppliers. The suppliers providing travel service for AG's tour programs and vacations are independent contractors and are not agents or employees of AG. To the extent that AG is involved in the sale of air and/or cruise transportation to you, AG acts as agent of the air carrier and/or the cruise line. For all other purposes, AG does not act as agent for any party whatsoever. AG is not responsible for the willful or negligent acts and /or omissions of such suppliers or of any air carrier and/or cruise line or their respective employees, agents servants, or representatives, including, without limitation, their failure to deliver or their partial or inadequate delivery of services. All coupons, receipts, invoices and tickets are issued subject to the terms and conditions specified by the suppliers, air carriers, and/or cruise lines. By utilizing the travel services of the suppliers, you agree that neither AG nor any representative shall be liable for any accident, injury, property damage, or personal loss to you or to those traveling with you in connection with any accommodations, transportation, or other travel services, or resulting directly or indirectly from any occurrences or conditions beyond AG's control, including but not limited to, acts of terrorism war, defects in vehicles, breakdown in equipment, strikes, theft, or delay or cancellation of or changes in itinerary or schedules. All pricing is subject to change. AG reserves the right to correct promotional or pricing errors at any time, or increase the program price in the event of cost increases due to changes in airfare, cruise fares, currency fluctuations, park fee increases, taxes or fuel surcharges. AG reserves the right to decline to accept or retain any person as a member of any tour or vacation at its discretion. AG and/or its tour director retain the right to terminate the participating (without refund) of any group member at their discretion, if such person's health, actions or general deportment impede the operation of the tour and or/causes any hardship to the tour director and/or other tour members. In such case, there will be no refund to the tour member for the unused portion of the tour, and all additional expenses incurred, such as airline ticket change penalties, transfers to the airport etc., will be the sole responsibility of the tour member whose membership was terminated. AG reserves the right to cancel or alter at its discretion and without notice, any tour or vacation including, but not limited to, change of dates, routing, change of hotels, meals, shows and/or sightseeing services of any itinerary and/or tour and/or vacation outlined in this flyer and/or brochure. If for any reason, AG changes a hotel(s) to a lower category, you may either accept the alteration or elect to cancel, in which case you will be entitled to a full refund. AG reserves the right to cancel any tour or vacation up to three weeks before departure if the number of passengers has not reached the minimum required to operate.
Sellers of travel in California are required by law to disclose the following: CST#2045443-40. Registration as a seller of travel does not constitute approval by the State of California. AG has a trust account and participated in the Travel Consumer Restitution Corporation (TCRC). Transactions made by passengers from outside of California are not covered by the TCRC. All payments for travel services not provided t the passengers shall be promptly refunded, in accordance with the agreed-to terms and conditions, upon written notice, either party may be excused from performing this agreement due to Acts of God, acts of terrorism, war, government regulations, disaster, strikes, civil disorder or other emergency making it illegal or inadvisable to travel.
